Terms of Service
Please read carefully
The following terms and conditions (these “Terms”) govern the provision by JonaHost.com. (“Company”) of the services and/or products described on the Order Forms, the Service Level Agreement and Service Exhibit attached hereto (collectively the “Service Descriptions”) and defined in any of the Company’s product support listing, to the customer (“Customer”) identified on the Service Descriptions. The Service Descriptions, these Terms and the attachments and any addenda hereto, executed with respect to the Services and Products, are referred to herein, collectively, as this “Agreement.”
1. Obligations of Parties
Company shall install Services and Products within five business days after execution by Company of all applicable Service Descriptions, unless otherwise specified in writing, and maintain the Services and Products that are designated in the Service Descriptions. Customer shall comply with all of the terms of this Agreement, including, but not limited to, the Acceptable Use Policy attached hereto as Attachment A (the “Use Policy”), as the Use Policy may be modified from time to time. Upon notice from Company, Customer promptly shall eliminate any hazard, interference or service obstruction that any hardware or software used by Customer, whether or not provided by Company (“Customer Materials”), is causing or is likely to cause. If Customer requests Company to assist it in removing any hazards, interference or service obstruction that Customer Materials are causing or are likely to cause, Company may, but is not required to, assist in such removal.
Jonahost can suspend/terminate a customer’s access for direct or indirect abuse of our company’s name, sales representative & support agents.
Charges for the Services and Products (including the charges described in the balance of this section, the “Charges”) are set forth on the Service Descriptions. Charges shall commence to accrue on the date that Company provides access codes to Customer (“Operational Date”). Charges shall be invoiced to Customer in advance at the beginning of the month. Any additional charges, including, but not limited to, any early cancellation charges, accrued interest, late fees and any usage-based charge, including, but not limited to, charges for network access to the Internet, shall be invoiced in arrears and shall appear on the monthly invoices for Services and Products or separate invoices. In all cases, payments for Charges are due upon receipt by Customer of the invoices for such Charges. Customer also shall pay to Company all expenses incurred by Company in exercising any of its rights under this Agreement or applicable law with respect to the collection of a Payment Default, including, but not limited to, reasonable attorneys’ fees and the fees of any collection agency retained by Company.
3. Payment Policy
Accounts in violation of our Terms and Conditions will be suspended with notice. These accounts can be cancelled if the violation remains in effect and a refund will not be drawn if the account is still within the first 30 days of activation.
We reserve the right to refuse service to any person at anytime for any reason.
We further reserve the right to cancel any established hosting account without cause or notice.
The Customer acknowledges that we are not responsible for any damages or data loss that you may incur as a result of our refusal of service or account cancellation.
Customers may cancel at any time by filling out the cancellation request form. All refund and cancellation requests must be through the above method. We reserve the right not to comply with verbal cancellation requests. Cancellations will not be considered complete until the JonaHost representative states the account has been canceled. We require at least 30 days notice of cancellation for dedicated servers.
JonaHost will terminate all suspended accounts with due invoices after 15 days of suspension if JonaHost do not receive a response from client.
If your hosting is up for renewal and you weren’t charged for it, or you weren’t able to pay for it, then your account will be suspended pending payment. Once, you pay your bill your service will be restored. You might want to make sure you contact us if you don’t have the money and want to ensure that your content doesn’t get deleted. You will not have access to your website files unless you pay your invoice for your account to be reactivated.
Money Back Guarantee Policy
You have a 30 days money back guarantee on managed shared hosting from the date of account creation.
There are no refunds on the following items:
– Dedicated Servers/VPS
– Lifetime Hosting Packages
– Administration/Service Fees
– Addons or Account Upgrades
– Domain Name Registrations
Single website hosting – Host one website: You can only host one website with any package that permits one website. This means you cannot have a website on domain.com and then another in domain.com/website. Failure to comply with this will result in your account being suspended. If you need to host more than one website, you must upgrade to a package that permits more than one website.
Lifetime hosting – Support response time is 3-7 working days. This package should be for advance to professional users. 6 support tickets is provided for 12 months period. Additional Support request can be purchased for $5/ticket
Only first-time accounts are eligible for a refund. For example, if you’ve had an account with us before, canceled and signed up again, you will not be eligible for a refund or if you have opened a second account with us. Any additional products added or upgraded on an existing account will not be eligible for a refund, only the first product ordered is eligible for a refund within the first 30 days of service.
Violations of the Terms of Service will waive the refund policy.
JonaHost will not be responsible for any damages your business may suffer. JonaHost makes no warranties of any kind, expressed or implied for services we provide. JonaHost disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by JonaHost and its employees. JonaHost Offers a 99.9% Uptime guarantee.
JonaHost does not include backups of their shared Hosting, VPS or Dedicated servers. Each Indevidual/Client is fully responsible for making their own backup. JonaHost accept no responsibility for any loss of data or consequences arising from this. JonaHost always advises clients to back up their site data regularly for their own protection.
Finally, JonaHost wishes to emphasize that in accepting services, customers indemnify JonaHost for the violation of any law or JonaHost policy, that results in loss to JonaHost or the bringing of any claim against JonaHost. This means that if JonaHost is sued because of activities of the customer that violate any law, or this policy, the customer will pay any damages awarded against JonaHost, plus costs and reasonable legal fees.
Failure to comply with any of our terms & conditions will result in grounds for immediate account deactivation.
JonaHost reserves the right to change, edit, or update the policies contained in this document, along with the content on our website at any time for any reason without notice.
Seo ip limit – Accounts can only use the alloted amount of ip’s that come with a package to use toward seo. If your package does not come with an ip you will be allowed only 1 ip address for seo. Ip’s used for ssl’s and valid uses will never been turned down. If found frauding ip’s for seo past these limits the account(s) will be up for suspension and or termination. Domains with a dedicated IP must be pointed to our servers else risk the dedicated IP being removed from the account.
Ip class’s – JonaHost can not promise that we will be able to provide different ip classes on a single server. If we so happen to get more then one class this can be done. This all depends on what is available from our datacenter.
Due to a shortage of IP addresses around the world each dedicated IP must be requested via the dedicated IP request form and will only be given if the requester has a complete and valid reason.
FREE SSL: Free Lets Encrypt is included with all hosting packages. This free SSL certificate will be free once you remain a customer of JonaHost
Account Restorations and Transfers
We at JonaHost will gladly provide up to 10 account restorations and up to 5 account transfers per month, per account. After this we will impose a $25 charge on a per-transfer basis. However, if you are a new customer (less than one month with service), you can have up to 5 accounts transferred for free. After the first 5 transfers the same $25 per transfer fee will apply to each additional transfer.
Termination: Non paying customers/suspended accounts will automatically be terminate after 30 days from the suspension date. All files, backups, email account and everything else on the server will be removed.
Shared Hosting Package Terms
The use of the any shared disk space or bandwidth package is subject to the following terms
All accounts must have valid, working websites, and not violate any previously subscribed terms
The use of web bots is strictly prohibited and will result in your account being terminated without notice or refund
Accounts are not for use of mass storage of backups, files, audio, video, zip files, or similar
Accounts are not for the use of mass distributing of files such as torrents or mirrors
Any accounts found to violate these terms may be suspended without notice until the account holder agrees to resolve the issue.
20% cpu and or memory for 2 minutes.
Combined 5% CPU & RAM over 24 hours.
500 email limit per domain per hour.
25 concurrent database connections at one time.
Apache threads to be open no longer then 999 seconds.
Php upload limit of 100MB.
Max php session time of 600 seconds or less.
